1. Scope of Application
These General Terms and Conditions (GTC) apply to all business relationships between Nordwest Rückbau (hereinafter referred to as the “Contractor”) and its customers (hereinafter referred to as the “Client”), unless otherwise agreed in writing. Any terms and conditions of the Client that deviate from these GTC shall not be recognized, even if not expressly rejected.

2. Services
Nordwest Rückbau provides specialized services in the following areas:
• Crime scene and deceased body site cleaning
• Asbestos removal (indoor)
• Demolition and dismantling work
• Disinfection
• Final construction cleaning
• Glass and special cleaning
All services are performed to the best of our knowledge, in accordance with applicable regulations (e.g. IfSG, TRGS, BGR, DGUV, BioStoffV), and based on the information provided by the Client.

3. Conclusion of Contract
A contract is concluded by:
• Acceptance of a written offer by the Client
• Confirmation via email or digital signature
• Commencement of work by the Contractor at the Client’s request
Verbal agreements are only valid if confirmed in writing.

4. Prices & Payment Terms
• All prices are quoted net plus applicable VAT.
• Payments are due immediately upon receipt of invoice, without deductions.
• In the event of late payment, the Contractor reserves the right to charge default interest of 9% above the base interest rate (§ 288 para. 2 BGB) and reminder fees.
• For projects exceeding €1,000, the Contractor may request an advance payment of up to 50% prior to the commencement of work.

5. Client Obligations
• The Client shall provide unrestricted access to the affected premises and areas.
• The Client must inform the Contractor in advance of any risks, hazardous substances (e.g. asbestos), structural conditions, and all relevant information.
• Electricity, water, and lighting must be made available by the Client.

6. Execution Conditions
• All work is carried out in compliance with legal regulations and with the utmost care.
• The Contractor is not liable for damage or deterioration resulting from the condition of the property or unreported circumstances.

7. Cancellation & Withdrawal
• If the Client cancels an order less than 24 hours before the scheduled start, a cancellation fee of 50% of the agreed amount will apply.
• If canceled within 48 hours of the scheduled start, 25% of the order value will apply.
• The Contractor reserves the right to withdraw from the contract if safety risks exist or incorrect information was provided.

8. Liability
• The Contractor is only liable for damages caused intentionally or by gross negligence.
• Any further liability – particularly for consequential damages, loss of profit, or third-party damages – is excluded.
• The Client is solely liable for damages caused by unreported hazardous substances (e.g. asbestos, biological agents).
• No liability beyond the statutory minimum is accepted for the cleaning or removal of health-hazardous materials.

9. Retention of Title & Disposal
• All materials and equipment used by the Contractor remain the Contractor’s property.
• Disposal of contaminated materials will only be carried out by separate written agreement and may incur additional charges.

10. Data Protection
The Contractor processes personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and solely for the purpose of fulfilling the contract. No data will be shared with third parties without the Client’s explicit consent.

11. Place of Jurisdiction & Applicable Law
The place of jurisdiction for all disputes is the Contractor’s registered office (Oberhausen, Germany), provided the Client is a business entity.
German law shall exclusively apply.

12. Severability Clause
If any provision of these GTC is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
